Terms of Service

1. The agreement
These terms are a contract between you and Nova Hawk Labs LLC, a Texas series limited liability company at 1122 Colorado St, Unit 1410, Austin, TX 78701 (“we”). By creating an account or using nookd you accept them. If you do not accept them, do not use nookd.
2. You must be 13 or older
nookd is not for children under 13, and we do not knowingly allow them to register. If you are between 13 and the age of majority where you live, you may use nookd only with a parent or guardian's permission. We close accounts we learn belong to children under 13 and delete their data.
3. What nookd is
nookd lets you catalogue the books you own, track reading, share libraries with friends, and join communities. It is provided free of charge. There is no subscription, no automatic renewal, and no charge of any kind, so there is nothing to cancel other than your account itself, which you can delete at any time from your profile settings. If we ever introduce a paid plan, we will disclose the price and the renewal terms before you are asked to pay, and cancelling will take no more steps than subscribing did.
4. Your account
Keep your credentials to yourself. You are responsible for what happens under your account. Tell us at support@nookd.us if you believe it has been compromised.
5. Your content stays yours
Everything you add to nookd, including your library, notes, posts, and the images you upload, remains yours. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, and display that content solely to operate nookd and to show it to the people you have chosen to share it with. That licence ends when you delete the content or your account, other than for copies sitting in routine backups until they roll off.
You promise you have the right to upload what you upload. Do not upload a book cover, photograph, or any other image you do not have permission to use.
6. Acceptable use
Do not use nookd to:
- break the law, or infringe anyone's copyright or trademark;
- harass, threaten, impersonate, or invade the privacy of another person;
- post sexual content involving minors, or content that promotes self-harm or violence;
- upload malware, scrape the service, probe it for vulnerabilities without our written permission, or evade rate limits and bot protection;
- resell or redistribute the service, or use it to build a competing dataset.
We may remove content and suspend or close accounts that break these rules.
7. Copyright complaints
If you believe something on nookd infringes your copyright, email support@nookd.us with the work you say is infringed, the URL of the material, your contact details, a statement that you have a good-faith belief the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for them. We remove infringing material and terminate repeat infringers.
8. Third-party material
Book metadata and cover art come from the Google Books API and from other users. We do not warrant that it is accurate or complete.
9. Ending it
You can delete your account at any time from your profile settings. Deletion erases your profile, content, and uploads, and it cannot be undone. We may suspend or close an account that breaks these terms, or discontinue nookd entirely, and we will give reasonable notice before shutting the service down where we can.
10. No warranty
nookd is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise it will be uninterrupted, error-free, or that your data will never be lost. Keep your own copy of anything you cannot afford to lose.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost goodwill. Our total liability for any claim relating to nookd is limited to one hundred US dollars. Some jurisdictions do not allow these exclusions, and where that is the case they do not apply to you.
12. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Disputes go to the state and federal courts sitting in Travis County, Texas, and you and we each consent to their jurisdiction. Nothing here prevents either of us from bringing a claim in small-claims court.
13. Changes
We may update these terms. If a change is material we will update the date above and give notice in the app before it takes effect. Continuing to use nookd after that means you accept the new terms.
